These terms and conditions govern the provision of scaffolding services by All Scaffolding Services Kent Ltd. By accepting a quotation or allowing work to commence, you agree to be bound by these terms.
1. Introduction and Acceptance
These terms and conditions ('Terms') apply to all contracts for the supply of scaffolding erection, hire, alteration, adaptation and dismantling services ('Services') provided by All Scaffolding Services Kent Ltd ('we', 'us', 'our') to any customer ('you', 'your').
By accepting a written quotation, signing a contract, or permitting work to commence on site, you confirm that you have read, understood and agree to be bound by these Terms.
These Terms apply to all domestic, commercial and industrial customers unless a separate written contract has been agreed and signed by both parties, in which case the terms of that contract shall take precedence over these Terms where they conflict.
2. Quotations and Estimates
All quotations are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. Verbal estimates are indicative only and do not constitute a binding quotation.
Quotations are based on information provided by you at the time of enquiry. If site conditions, access arrangements or the scope of work differ materially from those described, we reserve the right to revise the quoted price before or during the works.
Quotations do not include the cost of any permits, licences, road closures, highway authority fees or third-party consents unless expressly stated. It is your responsibility to obtain and pay for any such permissions.
3. Pricing, Payment and Invoicing
Our charges comprise an erection fee, a weekly or agreed-period hire charge, and a dismantling fee. These will be set out in your written quotation.
Invoices are issued on completion of erection and at the agreed billing intervals during the hire period. Payment is due within 14 days of the invoice date unless otherwise agreed in writing.
We reserve the right to charge interest on overdue amounts at a rate of 8% per annum above the Bank of England base rate, calculated daily from the due date until the date of payment, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
We reserve the right to suspend or remove scaffolding if payment is not received by the due date, after giving reasonable notice. We shall not be liable for any loss or delay arising from such suspension or removal.
4. Scaffolding Erection, Hire, Alterations and Dismantling
We will erect scaffolding in accordance with the agreed specification and in compliance with applicable health and safety legislation, including the Work at Height Regulations 2005 and relevant British Standards.
The hire period begins on the date of erection and continues until dismantling is completed. Hire charges continue to accrue until the scaffold is fully dismantled, regardless of whether it is in active use.
No alterations, adaptations, additions or modifications to the scaffolding structure may be made by you or any third party without our prior written consent. Unauthorised alterations may render the structure unsafe and will void any inspection certification.
Dismantling will be carried out within a reasonable time following your written request, subject to our scheduling and safe access being available. We require a minimum of 48 hours' notice for dismantling.
5. Customer Responsibilities
You are responsible for ensuring that safe, clear and reasonable access to the site is available for our operatives and vehicles at all agreed times. This includes removing obstructions, securing animals and ensuring the ground is suitable for erection.
You must inform us in advance of any underground services, overhead cables, restricted access, asbestos, fragile roofs or other hazards that may affect the safe erection or use of scaffolding.
You are responsible for ensuring that the scaffolding is used only for the purpose for which it was designed and erected. Overloading, misuse or use by unauthorised persons is strictly prohibited.
You must not permit any person to use the scaffolding who has not been made aware of any relevant safety instructions or restrictions. You are responsible for controlling access to the scaffold on your site.
You must notify us immediately if you become aware of any damage, instability, missing components or other safety concern with the scaffolding.
6. Site Conditions and Unforeseen Circumstances
Where site conditions are found to differ materially from those described at the time of quotation — including but not limited to ground conditions, access restrictions, the presence of services or structural issues — we reserve the right to revise the price and programme accordingly.
We shall not be liable for delays or additional costs arising from circumstances beyond our reasonable control, including adverse weather, third-party delays, utility diversions or changes in statutory requirements.
7. Scaffold Inspections and Safety
We will carry out a handover inspection on completion of erection and provide a handover certificate confirming that the scaffold has been erected in accordance with the agreed design and applicable standards.
Thereafter, it is your responsibility to ensure that the scaffold is inspected at least every seven days, and following any event likely to have affected its stability (such as high winds, impact or vandalism), by a competent person as required by the Work at Height Regulations 2005.
We offer a regular inspection service; please ask us for details. Where we carry out inspections on your behalf, we will provide a written inspection record. Our inspection service does not transfer your duty as the person in control of the site.
8. Damage, Access Restrictions and Delays
You are responsible for any damage to the scaffolding caused by you, your contractors, your tenants or any third party on your site (other than damage caused by our own operatives). The cost of repair or replacement of damaged components will be charged to you.
If access to the site is restricted or denied, preventing us from carrying out erection, inspection, alteration or dismantling at the agreed time, we reserve the right to charge for abortive visits at our standard day-rate.
We shall not be liable for any damage to underground services, drains, paving or other structures caused by erection activities where you have failed to provide accurate information about their location.
9. Cancellation and Termination
You may cancel a confirmed order by giving us written notice. If you cancel after we have mobilised resources or ordered materials, we reserve the right to charge a reasonable cancellation fee to cover costs incurred.
We reserve the right to terminate this agreement immediately if you fail to make payment when due, breach any material term of these Terms, or if we reasonably consider that continuing the contract would expose our operatives to unacceptable risk.
On termination for any reason, all outstanding hire charges and other sums due shall become immediately payable.
10. Liability and Insurance
We maintain public liability insurance and employers' liability insurance in amounts appropriate to the nature of our business. Details are available on request.
Our liability to you for any loss or damage arising out of or in connection with the Services shall not exceed the total value of the contract under which the claim arises, except in the case of death or personal injury caused by our negligence, or fraud, where liability is not limited by law.
We shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of revenue, loss of contract or loss of anticipated savings, whether arising in contract, tort or otherwise.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited by applicable law.
11. Complaints and Disputes
If you are dissatisfied with any aspect of our Services, please contact us as soon as possible so that we can address your concerns promptly.
We aim to acknowledge all complaints within two working days and to provide a substantive response within ten working days. If we are unable to resolve a complaint to your satisfaction, we will explain the reasons in writing.
12. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales.
The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
